1) Important notice

Scuba diving, freediving, snorkeling, boating, and other water activities involve inherent risks. By booking or participating in activities with ME Diving Khaolak Co., Ltd. (“we”, “us”), you acknowledge and accept these risks.

This page provides general information about liability, risk, and responsibilities. You may also be required to sign additional activity-specific waivers or training agency documents before participation.

2) Inherent risks

Risks can include (non-exhaustive):

• Drowning, near-drowning, panic, or loss of consciousness
• Decompression sickness, arterial gas embolism, barotrauma, and other pressure-related injuries
• Equipment malfunction or misuse
• Boat-related risks (slips, falls, injuries, weather exposure)
• Strong currents, waves, low visibility, and changing sea conditions
• Marine life hazards (stings, bites, cuts, allergic reactions)
• Heat illness, dehydration, sunburn, seasickness
• Remote location risks (limited access to advanced medical care, delays in evacuation)

3) Your responsibilities

• Provide accurate information: You must provide correct personal, certification, experience, and (where applicable) medical information.
• Follow instructions: You must follow safety briefings and instructions from our staff and the boat crew.
• Dive within your limits: You must stay within your training, certification limits, and comfort level.
• Fitness to participate: You must be physically and mentally fit for the activity and disclose relevant medical conditions.
• Equipment checks: You are responsible for checking your equipment fit and function and reporting problems immediately.
• Safe behavior: You must not act in ways that endanger yourself or others.

4) Safety decisions

• Our instructors, dive leaders, guides, and boat crew have the authority to make safety decisions at any time.
• This can include changing dive sites, limiting depth/time, requiring a refresher, stopping a dive, or canceling/ending participation if necessary for safety.

5) Waivers and training agency documents

• For many activities (especially scuba training and fun diving), you may be required to sign liability waivers, assumption-of-risk forms, and training agency documents.
• These documents may be required before you enter the water and may be provided digitally or in person.
• If you refuse to sign required documents, we may not be able to provide the service, and it may be treated as a customer cancellation (see Booking Terms and Refund Policy).

6) Limitation of liability

• To the maximum extent permitted by applicable law, our liability is limited for losses or damages arising from participation in activities that involve inherent risk.
• We are not responsible for losses resulting from factors outside our reasonable control, including weather, sea conditions, marine life, third-party actions, or participant behavior.
• Nothing on this page limits liability where it cannot be limited under applicable law.

7) Personal property

• You are responsible for your personal belongings. We recommend leaving valuables in a safe place.
• To the extent permitted by law, we are not liable for loss, theft, or damage of personal items during trips or at our premises.

8) Health, emergency response, and medical costs

• You are responsible for your own medical costs and any costs not covered by your insurance.
• In an emergency, you authorize us to arrange assistance (including emergency transport) if you are unable to do so yourself.
• We strongly recommend appropriate travel insurance and diving accident insurance.

9) Third-party operators

• Some components of your trip may be provided by third parties (e.g., boat operators, transport partners, marine park authorities).
• Where applicable, third-party terms may apply, and we may not be liable for acts or omissions of third parties beyond our control.

10) Acknowledgement

By booking and/or participating, you acknowledge that you understand the nature of the activities and the inherent risks involved, and you agree to take personal responsibility for your actions and decisions.
